The Legal Words You Must Say in Your Ceremony

When it comes to your wedding ceremony, you have a lot of freedom. You can choose your music, write your own vows, involve your pets, invite the kids, and make it as fun or as formal as you like. But, there are a few legal words that must be said in every ceremony to make your marriage official.

The Marriage Act 1961 sets out these words, and while they don’t take long, they’re absolutely essential. Think of them as the “non-negotiables” that make your marriage legally binding.

The Monitum (What I Say)

Before you exchange vows, I’ll say a short legal statement called the Monitum. It’s the part where I explain that marriage in Australia is between two people, entered into voluntarily and with a clear understanding of what it means. It might sound a little formal, but it’s an important reminder of the significance of what you’re about to do.

Then it’s over to you! Each of you must say this line in front of your witnesses:

“I call upon the persons here present to witness that I, [your full name], take you, [your partner’s full name], to be my lawful wedded [husband/wife/spouse].”

That’s it. Short and simple, but powerful. Once you’ve said those words, you’re legally married.
